Potential End to Presumptive Illness Status for Gulf War Veterans

One of the laws that provides our Gulf War veterans with the right to qualify for disability ratings is set to expire at the end of 2011, and many lawmakers are asking that the date be repealed.

Title 38 CFR 3.317 of the United States Code is the law in question that allows veterans of the Gulf War that have certain disabling conditions to be automatically determined as having developed the condition during their service and therefore automatically eligible for benefits. 

The original title is set to have this allowance expire at the end of 2011, meaning many veterans who would once have easily qualified for disability benefits may have additional work to do for their claim.

Lawmakers in support of keeping the presumptive illness determination for Gulf War veterans say that it's unfair that soldiers of this era are the only group facing a deadline like this. Veterans of previous wars such as Vietnam are still able to qualify for benefits through the presumptive illness determination, and they see no reason why Gulf War veterans should be any different.

In any case, there are still thousands of veterans who are unaware of matters such as these and how they can impact their lives.
